> Draft of 2026-10-28 for TAS-792. English translation of [../de/kuendigung-verbraucher.md](../de/kuendigung-verbraucher.md). Basis: Samir's decisions of 2026-10-27 and 2026-10-28 ([docs/decisions.md](../../../docs/decisions.md): the "Billing" row and the row "Cancellation and withdrawal go through our own page") and the implementation in [docs/specs/saas.md](../../../docs/specs/saas.md) (section "Billing"). Cancellation and withdrawal go through our own page without login (TAS-925, built; the page's texts: [cancellation-page.md](cancellation-page.md)), not through Stripe's customer portal. Open questions: [open-questions.md](../open-questions.md).

# Cancellation terms for consumers

These terms apply to **consumers** (§ 13 BGB) who have taken a **paid plan**. For businesses, § 5(4) of the [Terms](terms.md) applies. The free plan is governed by § 5(1) of the Terms.

## 1. Term and renewal

- The licence has a term of **one year** from activation (first licence year).
- After each licence year it renews for **a further year** unless you cancel. Before the renewal Stripe reminds you by email (Stripe's reminder feature; Stripe sets timing and wording) [check the setting when Stripe is configured].
- The licence year is paid in advance.

## 2. Cancelling in the first licence year

You may cancel **at any time**. The cancellation takes effect at the **end of the first licence year**; until then you keep using the licence. There is no refund in that period (for your right of withdrawal in the first 14 days see the [withdrawal information](withdrawal-information.md)).

## 3. Cancelling after the first licence year

From the second licence year you may cancel **at any time with one month's notice**:

- The licence ends **one month after the cancellation**; the period starts when you cancelled. If the current licence year ends sooner, the licence ends with it.
- **We refund the unused part of the paid licence year pro rata and automatically** to the means of payment you paid with. We refund once the licence has ended (not at the time of cancelling, so that you can still change your mind during the month without keeping a refund for a licence you continue to use).
- The refund goes back to the original payments (the newest first). A refund already made for the same licence is credited. If Stripe cannot carry out a refund, the licence still ends and we refund the rest another way [by hand; define route and period].
- If you moved to a larger plan during the licence year, we refund from each payment of the current licence year at most the amount it contains.
- **Calculation.** Refund = the plan's yearly price, capped at the amounts paid for it, × (end of the paid licence year − end of the licence) ÷ (end of the paid licence year − start of the paid licence year). We calculate in whole seconds and in cents and round down.
  *Example:* "3 sites" licence (€64.00), licence year from 1 September 2026 to 1 September 2027, the licence ends on 15 November 2026 at 12:00: refund = €64.00 × 25,012,800 s ÷ 31,536,000 s = **€50.76**.

## 4. How to cancel

1. **"Verträge hier kündigen" button.** The button **"Verträge hier kündigen"** (§ 312k BGB) is in the footer of every dashboard page, the sign-in page included, and on the billing page of the dashboard; the website (TAS-791) will carry it too [check the places at launch]. It leads to **our own cancellation page https://app.okconsent.com/kuendigen, where you do not have to sign in**. Stripe's customer portal is not needed for it and offers no cancellation; it now serves only payment methods, invoices and changing plans.
2. **Cancellation page.** On the page you name the contract, choose the type of cancellation (ordinary or extraordinary), give your name and the email address of your account (you may add the name of your organization if you have several) and the time at which the contract is to end ("at the earliest possible time" is preselected; otherwise a day, for an ordinary as well as for an extraordinary cancellation). On the next page you see your details and, where we can name it, the day on which the contract ends, and you confirm the cancellation with the button **"jetzt kündigen"**. The cancellation is made on receipt.
3. **Confirmation.** We confirm the cancellation to you **immediately** on the page and in text form (email to the address given), with the contract, the type of cancellation, the date and time of receipt, the day on which the contractual relationship ends (§ 312k BGB) and, if a refund follows, its amount. The other owners of your organization receive a copy. If you did not cancel, or want to take the cancellation back, undo it with the button "Das war ich nicht" in that email for as long as the contract runs, or write to us at once. To protect against abuse the page causes at most one email a day per customer; we handle a further declaration the same day by hand: the page names no day on which the contract ends for it, and the confirmation by email follows once we have sent it by hand. When a withdrawal is carried out three days after its receipt, we tell the owners by email that the licence has ended, the amount refunded and that we repay it without undue delay and in any event not later than fourteen days from the day on which we are informed about the decision to withdraw; when an owner undoes a declaration with "Das war ich nicht", we tell all owners by email what was undone and when. These two emails do not count toward the one email a day.
4. You can also cancel **without the button**: in text form to support@okconsent.com. The periods above apply then too.
5. We carry out an **ordinary cancellation** at once. It ends at the end of the paid licence year (businesses, and consumers in the first licence year) or one month after the cancellation (consumers after the first licence year); we tell you the day on the confirmation page and in the email, the amount of the refund in the email. A day on or before the earliest possible end counts as the earliest possible end; if you wish a later day we confirm receipt at once and handle the cancellation by hand. We confirm an **extraordinary cancellation** at once too, but examine it by hand; the contract does not end by itself. If a declaration cannot be matched to a contract we confirm it all the same and handle it by hand.
6. You declare your **withdrawal** (within the first 14 days of the conclusion of the contract) on the same page with the choice **"Vertrag widerrufen"** or in text form; see the [withdrawal information](withdrawal-information.md). We confirm receipt of the withdrawal and carry it out **three days after its receipt** (the contract runs on unchanged until then) unless an owner of the contract undoes it with the button "Das war ich nicht" in our email; a withdrawal made while signed in as an owner is carried out at once. We repay everything you paid without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract, less the value of the days used until receipt if you expressly asked when buying that we begin before the withdrawal period ends. The value of the days is the price × the time used ÷ the length of the paid licence year, in whole seconds and cents, rounded down. *Example:* €64.00 after 5 of 365 days: €0.87 deduction, €63.13 refund.

## 5. What happens after cancelling

When the licence ends, your organization moves to the **free plan**. The consequences in § 7 of the [Terms](terms.md) apply: features of the paid plan switch off, nothing is deleted at once, consent records beyond 365 days are hidden for 30 days and then deleted, and if you have more than one site you choose which stays active. We warn you beforehand by email and in the dashboard.

## 6. Changing to a larger or smaller plan

- **Larger plan:** the change is charged at once with a pro-rata invoice for the remaining time and takes effect when the payment has been received. If the payment fails, your previous plan stays; your licence does not end because of it.
- **Smaller plan:** the change takes effect at the end of the paid licence year.
- Changing plans is done in Stripe's customer portal, which is linked from the dashboard under "Billing"; it offers no cancellation.

## 7. Termination for good cause

The statutory right to terminate for good cause (§ 314 BGB) is unaffected.
